The appearance of a product or part of a product (its shape, contours, colours, lines or ornamentation) can be protected if it is new and has individual character.
In Switzerland and the EU, a registered design can be maintained for up to 25 years, renewed in five-year periods.
Switzerland and the EU allow a 12-month grace period after the designer’s own disclosure, but relying on it carries risk. Filing before any disclosure is the safest route.
Through the Hague System you can file one international application designating several member parties, including Switzerland and the EU, or file EU and national applications directly.
Yes. Both Swiss and EU design applications can request deferment of publication, for up to 30 months from the filing or priority date, keeping a new product confidential until launch.
